Program Description: This program covers the use of Limitation of Liability (LOL)/Risk Allocation provisions in AE/Owner and/or AE/Sub-consultant agreements for services, the difference between LOL and limits of insurance, as well as how to negotiate LOL with clients.
Learning Objectives: At the end of this program,participants will be able to:
- Understand the risk allocation provision known as Limitation of Liability.
- Understand how to negotiate a fair and reasonable professional services contract with an owner. Negotiations related to limitation of liability will also include a discussion of the scope of services outlining the participants role on projects
- Understand how to write a limitation of liability clause as well as how to follow the AIA code of ethics guidelines when negotiating a contract.
- Understand how to respond to objections of the use of limitation of liability in their contract.
